Competition Officials Working Together on Best Practice Remedies

Malaysia, 10-12 September 2019 - Twenty-eight competition officials from Indonesia's Komisi Pengawas Persaingan Usaha (KPPU), the Philippine Competition Commission (PCC) and the Malaysia Competition Commission (MyCC), together with the Australian Competition and Consumer Commission (ACCC) met to consider and discuss approaches to identifying, negotiating and enforcing remedies for competition law infringements.

Delivered for the second time this year, this three-day workshop deepened participants' understanding of the function and purpose of remedies for competition law infringements and increased their confidence in negotiating and implementing such remedies. The workshop focused on peer-to-peer learning and practical activities on the following topics: structural and behavioural remedies; negotiating and accepting commitments; crafting effective remedies; voluntary and coercive remedies; monitoring and enforcing compliance; and international cooperation. Ms Lianne Ivy Medina, Assistant Director, Mergers and Acquisitions Office at the Philippine Competition Commission commented: "The CLIP Module 5 Workshop on Remedies for Competition Law Infringements is very timely. The Philippine Competition Commission is set to issue its Guidelines on Remedies next year. The intensive lectures and workshops gave us valuable information that we can use in preparing our guidelines. We particularly appreciate the sharing of experiences by the representatives as we are able to explore how cases involving remedies actually play out and what policies have proven to be effective."

This workshop was organised by the ACCC, with support from the ASEAN Secretariat, as part of the multi-phase Competition Law Implementation Program (CLIP) under the ASEAN-Australia-New Zealand Free Trade Area Economic Cooperation Support Programme (AECSP). Currently in its third phase, CLIP promotes collaboration between competition agencies in the region to share resources, skills and techniques.
